Step 1 - Affidavit Submission: Prepare an affidavit from a notary who will include the details such as your current name, new name, reasons for change and current address. The paperwork will need signatures of two gazetted officers.
Step 2 - Announcement Through Advertisement: Post an advertisement to notify the public about the change in name and make it officially active. Mention the current name, old name, father’s name or husband’s name and address. You should post the advertisement in local daily newspapers such as Times of India, Dainik Bhaskar or any other vernacular language daily of that particular region.
Step 3 - Gazette Notification: Make an arrangement to publish an announcement in the Gazette of India. Submit a copy of the advertisement published along with other documents required to the Department of Publication under the Ministry of Urban Development of India.
If there has been some spelling mistake in the name of the owner in land registry, it can be done by visiting the registrar’s office with proof mentioning correct spellings of the name.
If the authority does not approve of your application, you can issue a registered deed of rectification to correct errors in the name in any deed, including sales deed. Added to that, you can also register a case before the revenue officer along with an affidavit for name change in property documents.
Another possible way is to obtain a certificate from the Tehsildar mentioning that both names belong to the same person. This certificate will hold value in case of legal affairs.
Legal procedure to change the name of the owner in property documents is an uncomplicated one but will take quite some time. There is another way of doing so by changing the name in the deed of sale, but this has certain limitations. It will require efforts from both the new and current owners to make this happen.
