What Are the Different Sections and Sub sections of Form GSTR 5A?

GSTR 5A form can be better understood through the sections and sub-sections of 7 tables and one sub-table.

Section Purpose
Table 1 GSTIN of the supplier (OIDAR provider)
Table 2 Legal name and trade name (if any) of the registered person
Table 3 Name of the authorised representative in India (if non-resident files through a representative)
Table 4 Period of the return (month and year)
Table 5 Taxable outward supplies made to non-taxable online recipients (i.e. unregistered persons) in India. Fields include Place of Supply, Taxable Value, Rate, Integrated Tax, CESS.
Table 5A Amendments (additions / corrections) to taxable outward supplies to non-taxable recipients in previous periods. Only Taxable Value, Rate & Cess fields can be amended.
Table 5B New table (added via 2023 amendment) to report supplies to registered persons (other than non-taxable recipients) on which tax is payable by them under reverse charge.
Table 5C Amendments to supplies in Table 5B (i.e. corrections in past period’s reverse charge supplies)
Table 5D Supplies of online money gaming services made to persons in India

What Are the Penalty or Consequences for Not Filing GSTR 5A?

As per the most recent government notifications, non-resident OIDAR service providers who fail to file GSTR-5A by the due date (20th of the following month) are liable to pay a late fee.

  • For ordinary returns, the penalty is ₹200 per day (₹100 CGST + ₹100 SGST), capped at ₹10,000 per return. 
  • For Nil returns, the late fee is ₹100 per day (₹50 CGST + ₹50 SGST), also capped at ₹10,000. 

 

These rates replace the older figures of ₹50 and ₹20 per day, which are now outdated. Additionally, if there is any tax liability, interest is applicable on the overdue amount and must be calculated as per law, typically at 18% per annum, and reported in Table 6 of the GSTR-5A form.
